By accessing or using MEMP Bot, the MEMP website, or any related service, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. These provisions are intended to maintain a fair, secure, and sustainable environment for all users.
By using any part of the MEMP Services, you agree to comply with these Terms & Conditions, applicable MEMP policies and guidelines, Discord's applicable Terms of Service and Community Guidelines, and all applicable laws and regulations. If you do not agree, you must stop using the Services.
MEMP refers to the MEMP Bot and its operators. Services includes the MEMP Bot, website, APIs, databases, economy, features, digital goods, and related services. Virtual Assets include Feathers, Silver Feathers, items, collectibles, Kwami data, experience, achievements, levels, and other in-service values. Digital Perks are digital benefits associated with a contribution, membership, or purchase. Exploit means any unintended behavior, vulnerability, bug, loophole, technical error, or system weakness used to obtain an unintended advantage.
Feathers, Silver Feathers, items, collectibles, Kwami data, progression, and other Virtual Assets are fictional, server-only digital assets. Unless expressly stated otherwise, they are not legal tender, financial instruments, deposits, investments, or cash balances, and cannot be withdrawn or redeemed for money. Possession of a Virtual Asset does not create a permanent right to retain it.
MEMP may modify earning rates, prices, rewards, drop rates, balances, progression, leaderboards, item availability, or other economy mechanics. MEMP may correct transactions affected by technical errors, incorrect pricing, duplicate purchases, duplicate rewards, accidental Feather grants, failed reversals, or database inconsistencies. Users must not intentionally retain, transfer, or spend Virtual Assets they know or reasonably should know were incorrectly granted.
Where reasonably necessary for balancing, security, technical, administrative, or operational reasons, MEMP may partially or completely reset, remove, restore, or wipe Virtual Assets and related progression. A database restoration or rollback may reverse transactions, rewards, progression, achievements, rankings, or balances created after the selected backup point.
You must not exploit bugs, duplicate rewards, manipulate the economy, abuse unintended mechanics, bypass intended limitations, interfere with APIs or databases, or use macros, scripts, automation, self-bots, unauthorized software, packet manipulation, or other methods to obtain an unfair advantage, unless expressly authorized by MEMP.
If you discover an Exploit that can provide an unintended advantage, you are expected to report it through the appropriate MEMP support channel and stop using it. Virtual Assets obtained through an Exploit may be invalidated even after they have been transferred, traded, spent, or used to obtain other rewards. Users who knowingly receive, transfer, purchase, spend, or otherwise benefit from exploited assets may also be subject to enforcement.
You are responsible for activity performed through your Account. You must not impersonate others, intentionally share access for abusive purposes, use another person's Account without authorization, or create or use alternative Accounts to evade enforcement. MEMP is not responsible for losses caused by unauthorized access to a user's Discord Account or inadequate account security.
MEMP may issue warnings, restrictions, temporary suspensions, permanent bans, Virtual Asset removals, progression resets, data wipes, transaction reversals, or other appropriate enforcement where a user violates these Terms, abuses the Services, commits fraud, exploits bugs, evades enforcement, uses unauthorized automation, or creates a significant risk to MEMP or its users. Enforcement may be applied with or without prior notice depending on severity.
Certain MEMP features may be supported through voluntary contributions, memberships, subscriptions, or purchases made through third-party platforms. A payment may provide access to a Digital Perk described at the time of purchase. Digital Perks may include memberships, ranks, cosmetic features, Virtual Assets, additional functionality, or other digital benefits.
Perks are provided for the period and under the conditions specified by the applicable offering. MEMP may modify, replace, rebalance, or discontinue a perk where reasonably necessary for technical, operational, security, legal, or administrative reasons. Making a payment does not provide immunity from moderation, guarantee continued access to MEMP, guarantee permanent availability of a feature, or override these Terms.
Unless otherwise required by applicable law, payments for Digital Perks and digitally delivered benefits are generally final once the applicable benefit has been delivered or made available. Nothing in these Terms is intended to exclude or restrict mandatory consumer rights that cannot lawfully be waived. Refund requests may be reviewed through the designated support process.
A chargeback or payment dispute occurs when a payment is reversed, disputed, or challenged through a bank, card issuer, payment provider, or financial institution. Users must not initiate fraudulent or abusive disputes. Where a delivered purchase is reversed, MEMP may revoke associated Digital Perks, reverse associated Virtual Assets, restrict functionality, require settlement of an outstanding amount, suspend an Account, or permanently terminate an Account in cases of suspected fraud or repeated abuse.
The Services are provided on an "as-is" and "as-available" basis to the maximum extent permitted by applicable law. MEMP does not guarantee uninterrupted availability, error-free operation, permanent feature availability, or continuous access to data.
Services may be interrupted due to maintenance, updates, technical failures, hosting issues, database problems, security incidents, Discord-related issues, third-party outages, or other circumstances beyond MEMP's reasonable control.
MEMP may maintain backups for operational and security purposes, but backups are not a guarantee that every piece of data can be restored. In the event of corruption, exploitation, technical failure, or another serious incident, MEMP may restore the Services to an earlier backup state, which may result in the loss or reversal of Virtual Assets, transactions, progression, rewards, achievements, rankings, or other data created after the selected backup point.
All original MEMP code, systems, mechanics, databases, website designs, branding, text, interfaces, original artwork, and other original materials remain the property of their respective owners. Unless expressly permitted, users may not reproduce, redistribute, commercially exploit, or reverse engineer MEMP's proprietary materials or represent them as their own.
MEMP may rely on Discord, hosting providers, payment providers, authentication services, analytics providers, and other third-party infrastructure. MEMP is not responsible for outages, policy changes, account restrictions, or other actions taken by third-party providers. Your use of third-party services remains subject to their respective terms and policies.
To the maximum extent permitted by applicable law, MEMP and its operators shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use or inability to use the Services, loss of Virtual Assets, economy resets, database restoration, account suspension or termination, service interruptions, technical errors, or third-party failures.
You are responsible for losses, claims, liabilities, or reasonable expenses arising from your violation of these Terms, misuse of the Services, fraudulent activity, or violation of applicable law, to the extent permitted by law.
MEMP may process information necessary to operate, secure, and maintain the Services, including information associated with Discord accounts, servers, commands, transactions, Virtual Assets, moderation actions, and technical functionality. The collection, use, retention, deletion, and other handling of personal data are governed by the MEMP Privacy Policy.
MEMP may modify, replace, suspend, or discontinue any part of the Services, including commands, features, Virtual Assets, Digital Perks, economy mechanics, APIs, databases, or websites. MEMP may also terminate or restrict an Account where permitted by these Terms.
Unless otherwise required by applicable law, termination does not create an automatic right to reimbursement for previously purchased Digital Perks.
Where an appeal process is made available, users may submit an appeal through the designated MEMP support system. An appeal does not guarantee reversal. MEMP may withhold sensitive detection methods, security information, or internal evidence where disclosure could compromise the integrity of the Services.
MEMP may update these Terms from time to time, and the "Last Updated" date identifies the current version. Continued use after an effective revision constitutes acceptance to the extent permitted by applicable law. If any provision is invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. Nothing in these Terms is intended to remove mandatory consumer rights or protections granted by applicable law.
Questions regarding these Terms, purchases, payment disputes, exploit reports, Account restrictions, or other MEMP-related issues should be submitted through the official MEMP support channels.
Security vulnerabilities and Exploits should be reported privately rather than publicly distributed in a manner that could enable further abuse.
